a focus on domestic violence and requiring new recruits be at least 25 years old. recruits are required to meet with community groups to better understand the city. but more people in the streets are saying that crime is the know the cops' fault. >> the problem is it's the parent. that's what it boils down to the parents. they are not instilling in their kids that it's not a game when you shoot somebody. >> it's a sheared responsibility. we have an obligation to police the city but we don't have an obligation to raise your children. >> reporter: as the police department looks to add possibly 80 more officers to their existing force of 616 next year, jubrille jordan's family cherishes memories of the past and her community wonders about the future. >> these baby, not fair to them at all. i don't think it's fair. this little girl is an innocent bystander. >> reporter: police will discourage gunfire overnight.

being it is new year's eve they know people will be firing their guns up into the air. in oakland, ann notarangelo, cbs 5. now to san jose, which has also seen a rise in killings thisser. >> this map was generated by the "san jose mercury news" showing where each of the city's 46 homicides occurred. cbs 5 reporter patrick sedillo has more on what was hopefully the last murder of 2012. >> we're treating it as a homicide scene. >> reporter: san jose marked the last day of 2012 with yet another homicide are, bringing the murder rate to 46 for the year. >> there are some cameras. we haven't been able to pull up what's on them yet. >> reporter: at about 9:30 a.m., san jose police received a call of an armed man in this apartment complex at the intersection of lewis and wong. >> so i woke up in the morning and then i heard eye loud gunshot and followed by screams. >> reporter: by the time crews arrived he was dead at the scene. >> once we determined it was probably going to be a

homicide, just ramped up the manpower. >> reporter: this video last week of roll call shows how depleted the force is. layoffs meant fewer officers on the streets and more criminals committing crimes. just look at the numbers. in 2009, there were 28 homicides. 20 in 2010. and nearly doubling in 2011. and now this year brings 46. >> wow. that's disturbing. >> reporter: judy thompson says she moved to san jose because she thought it was a safer place to bring up her children. >> very scared. you know, when you're a single parent and you have kids, you worry about them all day every day. >> reporter: san jose's murder rate spiked in august when 11 murders were reported. that being partly blamed on last year's layoff of 65 officers as well as resignations. >> even thinking about that, it's very disturbing. >> reporter: as recently as 2010, san jose had bragging rights of being one of the nation's safest cities. now today on the last day of 2012, it's the third most dangerous city in the bay area.

reporting from san jose, patrick sedillo cbs 5. san francisco rounds out this dust surging trend with a -- discouraging trend with a homicide increase. the city averaged nearly 6 murders a month in 2012 and as of this afternoon, the annual homicide total stood at 68. that's a 36% spike from last year when there were 50. other headlines from around the bay area. two of the four suspects arrested in the murder of wealthy silicon valley venture capitalist ravi kumra are expected to be arraigned. they are accused of killing him in his mansion in november. the other two suspects have been charged for their involvement in the crime. a woman accused of killing a pedestrian at a popular san francisco overlook pleaded not guilty today. 23-year-old gina eunice appeared in court today on charges of vehicular manslaughter, dui, and hit-and- run. police say that her blood

alcohol level was nearly three times the legal limit when she hit three people near twin peaks. one pedestrian died. and two people are recovering from an overnight house fire in san francisco's excelsior district. firefighters were called to the 100-block of athens street just before 1:00 this morning. the flames were out in less than 25 minutes but not before doing $400,000 in damage to the two-story home. freezing temperatures overnight created hidden dangers on some bay area roads. black ice. in the north bay, a toyota tundra ended up on its side this morning. the driver satisfies he was going less than 30 miles an hour on petaluma boulevard when he lost control and ran off the road. he wasn't seriously hurt. in the east bay, the chp says black ice caused two crashes on san pablo dam road between richmond and orinda. they happened within about 100 feet of each other. no one was injured. and it's another cold night getting under way. roberta gonzales with more on what to expect if you're

avoid the "fiscal cliff." the news comes just three hours before the new year's deadline. cbs 5 reporter grace lee on where it all stands now. grace. >> reporter: late developments brian. this all coming together in the last several minutes. what we have just learned is that the senate will be voting tonight before midnight. that's the deadline and you can see we have a live look at the u.s. capital as of right now. we are also just hearing that the vice president is headed right here to the capital to brief senate democrats on the details of the deal that they will be voting on toinght. for individuals making more than 400,000 or households more than $450,000, their tax rates are expected to go up next year. for two million jobless americans, their unemployment benefits should be extended at least another year. and that so-called inheritance tax will go from 35 to 40%. but even with all these

compromises, it is likely that most of us will be shelling out more cash to the irs come next year. >> you know, keep in mind that just last month republicans in congress said they would never agree to raise tax rates on the wealthiest americans. obviously, the agreement that's currently being discussed would raise those rates and raise them permanently. [ applause ] >> now -- >> guess what. you may not get any more revenue. you may not get any more economic growth. but you can say, i stuck it to the rich people. >> reporter: only capitol hill, the blame game is in full throttle with just a few hours left before we take the "fiscal cliff" plunge at midnight eastern time. >> i want everyone to know i'm willing to get this done, but i need a dance partner. >> reporter: vice president joe biden and senate minority leader mitch mcconnell have been trying to hammer out a last-minute agreement. they have agreed on a few issues but both sides are making concessions. if the deal passes, it looks like democrats will keep

popular items like a five-year extension on the child tax credit. it's for workers who do not earn enough to pay income taxes. also, the refundable credit for parents who have children going to college should stay in place. that would help families pay for tuition costs that continue to rise across the nation. and for healthcare providers who treat medicare patients, about $30 billion will be expected to help pay the costs for at least one more year. but what most of us will have to pay, the payroll tax forestial security. it is going up 2 points starting tomorrow. and that means if you earn $100,000 a year, you will pay an extra $2,000 next year out of your paycheck. now, we're still baiting to hear details on the deal between the white house and the gop but what we do know is that we get a little bit of a reprieve because tomorrow is a holiday so the markets will be closed tomorrow and those spending cuts that are scheduled are not supposed to begin until january 2. so

depending on the deal they reach later tonight, we'll see what happens. brian. >> thank you, grace lee. there is another important deadline looming tonight for many americans who lost their homes to foreclosure. those who feel their banks didn't play by the rules have until midnight tonight to apply for an independent review. the program is part of a government settlement with 14 major lenders who violated foreclosure rules through tactics like robo signing and document forgery. former homeowners can be compensated up to $125,000 if they can prove their lender wronged them. and when the calendar flips, so will taxpayers. which bay area community will boast the highest sales tax come tomorrow morning. >> and if you used this day to do some winter cleaning were you not alone. the long lines as people tried to beat the deadline for the 2012 tax savings. >> and one more thing to remember before you head out celebrating tonight. don't drink and walk. we'll explain.

ring in the new year. and along with an army of police officers to kept an eye on them. but as cbs 5 reporter linda yee tells us, it's not just drunk drivers they will be looking for. linda. >> reporter: well, that's for sure, liz. you've heard the warning, don't drink and drive. well, here's another one: don't walk while being drunk. extra cops will be on patrol throughout the streets of san francisco tonight. they are keeping an eye out for public drunkenness. any violators, that is a quick trip to jail. the barricades are ready. the public conveniences standing by along the embarcadero. and if past years are any indication, thousands are expected to hit the streets tonight to ring in the new year. but here's a sobering thought. don't even think about walking wheel drunk. >> drinking in public is against the law in san francisco. possessing an open container of alcoholic beverage is against the law in san francisco. >> reporter: the celebrations already started at some

restaurants and bars. >> new year's, we're expecting that. >> tonight we're just going to my cousin's house and having some drinks. >> reporter: police say it's when you leave parties where some may get in trouble. officers doesn't expect a rowdy street celebration like the night the giants won the world series but extra cops will be on patrol. and there is zero tolerance for public drunkenness. >> don't drink to the point where you're stumbling that you can't walk straight, that you can't be conscious of your own safety. we definitely don't want to see somebody drunk to the point where they're falling down, falling downstairs, wandering into traffic. those are the types of behavior that we're talking about which usually gets a trip to the drunk tank. >> reporter: are you celebrating with a little drinking? >> a little bubbly yes. >> reporter: you know there's a lot of laws about not being drunk in public? >> yes, definitely. taking bart. >> reporter: definitely take public transportation after drinking. but if you get sick and throw up in a cab, it will cost.

the law allows cab drivers to charge $100 on the spot to clean up the mess. so everybody can celebrate but you have to be careful. definitely don't drink and drive. now, there is going to be a dui chick point tonight in san francisco at 8th and folsom streets. it will start at 8:00 and will continue until the very early- morning hours between 2 a.m. and 3 a.m. so we have to be careful. but happy new year anyway, elizabeth. >> worth repeating when in doubt, take public transportation. thank you. on the subject of worth repeating, we'll say it again, you can leave the driving to others. in san francisco, muni offers free rides from 8 p.m. to 6 a.m. tomorrow with some lines running later than usual. in the south bay, all vta bus and light rail is free between 7 p.m. and 4 a.m. caltrain is free southbound only beginning at 11:00 tonight and running until 2:15. bart is not free. but it will be running trains

bring after a year filled with austerity measures. the latest unemployment race for greece is at more than 26%. breaking news out of washington. after weeks of back-and-forth bickering we may have a deal on the "fiscal cliff." it is not literally the 11th hour but it's close. according to a democratic aide who says the white house has reached an agreement with congressional republicans, is essentially a done deal but let's get the latest. cbs reporter randall pinkston joins us live from capitol hill with the details. randall. >> reporter: brian, just minutes ago we saw vice president joe biden's motorcade arrive on the grounds of the nation's capital. he is in there right now briefing members of the democratic caucus about the details and here are some of those details. the sequester which is supposed to take place tonight the automatic spending cuts have been put off for two months to give democrats and republicans, the white house and congressional leaders time to work out a longer deal. but right now, they have one

that will at least avoid the nation and the economy going off that so-called "fiscal cliff." the senate is close to a deal as the clock ticks toward midnight and the nation teeters on the edge of the so-called "fiscal cliff." >> let's pass the tax relief portion now. let's take what's been agreed to and get moving. >> reporter: the tentative deal would extend bush-era tax cuts for families making $450,000 a year and individuals making $400,000. it would also increase the taxes on estates worth more than $5 million and extend unemployment benefits for one year. president obama said he would have preferred a grand bargain that solved all of washington's revenue and spending problems. >> with this congress, that was obviously a little too much to hope for at this time. [ laughter ] >> it may be we can do it in stages. >> reporter: negotiations have been going on all day. lawmakers and aides moving back

and forth between meeting rooms here on capitol hill on what is normally a quiet new year's eve. the major sticking upon the now is spending. the president suggested lawmakers make action on deficit reduction in the next few months and that more tax revenue could be involved in those discussions. but republicans are furious at that possibility. >> i'm willing to support revenues to deal with this problem. the overall problem. but what i will not grow to is using revenues to replace spending reductions. >> reporter: even if the senate approves the deal by midnight the house still has to pass the measure before the president can sign it into law. the house left earlier this evening, but it doesn't matter in terms of the "fiscal cliff" agreement because the senate still has to vote on it. it's unlikely that they can get it done by midnight. so while the nags is technically over the cliff, it's only for a few days, we hope. reporting live in washington, i'm randall pinkston. back to you.

>> brian. >> i'm curious, all this -- this is all unwound in the last 30 minutes according to a democratic aide. is there any indication they will have an official announcement in the next few hours about specifically what is happening at this moment? >> reporter: we don't know whether there will be any official announcement. but we do expect cameras to be hot on the floor of the senate when they do convene. we're also expecting some talk from some senate leaders when the caucus breaks up in the capital. so we expect to hear something tonight. i can't tell you whether it's going to be in the form of an official announcement or senators explaining what the vice president told them is worked out with republicans. >> thank you, a busy new year's eve on capitol hill. thank you, randall pinkston. the u.s. is also dangerously close to another less publicized cliff, the dairy cliff.

congress has until tomorrow to replace or extend the expiring 2008 farm bill. otherwise, we revert to government price protection measures that date back to the '40s leaving you paying $7 a gallon or more for milk. amazingly the stock market didn't step off the "fiscal cliff" today. in fact, it surged on investor optimism that a deal would be reached. the dow closed out 2012 above the 13,000 mark. that's a 7% gain on the year. the nasdaq and the s&p also edged higher. the u.s. state department is facing scathing criticism in a new senate report about the attack on the u.s. mission in benghazi. the senate homeland security committee is faulting the state department for keeping the u.s. mission in benghazi open despite a deteriorating security situation there. it also faulted the state department for waiting for specific warnings instead of improving security. >> we should have closed this facility in benghazi until we

were prepared to provide the security necessary to give minimal protection, adequate protection, to american personnel. >> the attack on september 11th resulted in the deaths of four americans including ambassador chris stevens. the report recommended u.s. intelligence agencies widen their focus in libya and beyond to include new violent islamic extremist groups. secretary of state hillary clinton remains in a new york hospital after complications related to a recent concussion. as cbs news reporter adriana diaz reports, the trouble was discovered during a routine follow-up to her first hospital visit. reporter: former president bill clinton vivid the hospital where his wife hillary will be spending new year's eve. the secretary of state is being treated at new york- presbyterian for a blood clot. clinton's doctor said in a statement, the clot is in the vein between the brain and the skull behind the right ear. it did not cause a stroke or

neurological damage and they are dissolving it with blood thinners. senator joan lieberman has known her since law school. >> just want to say how much secretary clinton is in our prayers this morning and hope she recovers rapidly from this health problem. >> reporter: clinton had hoped to be back at work this week but doctors want to monitor her blood clot for at least a couple of days and they are on the lookout for any other issues related to concussion. that concussion happened earlier this month when the 65- year-old secretary fainted from dehydration after a stomach virus. she had been on a grueling schedule traveling more than any other secretary of state in history. clinton is planning to step down from her job in the next few weeks and habit ruled out another run for president. for now, her doctors say she is in good spirits and they are confident she will make a full recovery. adriana diaz for cbs news, new york. two federal investigators are heading to the site of a tour bus crash that killed 9 people in eastern oregon. the ntsb is looking into conditions on interstate 84 and

the guardrail that the tour bus crashed through yesterday morning. more than 40 people were aboard the bus heading from las vegas to vancouver. the bus was carrying mostly exchange students from south korea. you have been warned! ride the bumper cars at your own risk. and if you get hurt, you can't sue. today the state supreme court ruled a south bay doctor could not sue great america for breaking her wrist on the bumper cars. the court says there's a, quote, assumption of risk on the such rides. well, earlier this evening we told you how just about everybody will see their paychecks shrink a little next year. but that's not the whole story. the bay area workers who will see their earnings jump- starting tomorrow. >> i mean, it's not the only reason why i donate, but why not? it's a win-win for everybody. >> on a day when many of you didn't have to work, there was plenty to be done. the last-minute rush to save a little money. moscow's red square to ringn kremlin

share with you. our percentage of normal stats for the last day of the december, 145% of normal in oakland, 158% of normal in santa rosa. no two winters are alike. now we have a changing weather pattern. areas of low pressure well to the north of the bay area, we saw this latest one in the pacific northwest and falling apart rapidly in the bay area. so for the new year we have a new forecast. we're entering a dry weather pattern. but with the cooler air over the bay area until something can push it out, we have moderate air quality. it's the first one of the winter season, a "spare the air" day for tuesday. and to compare this time last year, we already had 11 last year. tomorrow highs very cool again averaging 3 to 7 degrees below normal in the 40s and 50s.

low 50s around the central bay. again, the winds with pretty much nonexistent. and here you have the extended forecast. wednesday, full-on sunshine. by thursday we have a front in the bay area that falls apart but nevertheless that should kick out some of the stagnant air. saturday and sunday, partly sunny with temperatures in the 50s. and we'll flirt with 60 degrees by the weekend. that is your pinpoint forecast. we still have vern glenn in the house on deck up next.
